Terms of Service

These Terms of Service ("Terms") are an agreement between you and CommunityCAD, a service operated by Iron Pixel Labs LLC, a Florida limited liability company ("CommunityCAD", "we", "us"). They cover your use of the website at communitycad.dev, its API, and the CommunityCAD for Klipper plugin's connection to it (together, the "Service").

Please read them. By signing in to or using the Service, you agree to them. If you don't agree, don't use the Service.

Also part of these Terms:

• the Community Guidelines: what you can post and how to behave;
• the Creator Terms, if you upload models or receive donations;
• the DMCA and Copyright policy.

How we handle personal data is explained in the Privacy Policy.

1. Who can use CommunityCAD#

• You must be at least 13 years old. If you're under the age of majority where you live, you must have a parent or guardian's permission, and they agree to these Terms for you.
• When you sign up we ask for your date of birth. You must give your real date of birth; giving a false one breaks these Terms. It's used to apply age rules, including that people under 18 can't see 18+ content (section 3.5).
• To pay for anything or receive donations, you must be an adult who can enter into a binding contract, or have a parent or guardian do it for you. Receiving payouts also needs Stripe's own requirements to be met.
• You can't use the Service if we've previously closed your account for breaking these Terms, or if the law forbids you from using it.

2. Your account#

• You sign in with a Google or GitHub account. You're responsible for keeping that account secure, and for everything done through your CommunityCAD account and any printer you link to it.
• You agree to these Terms by ticking the box on the sign-up screen, and we record which version you agreed to and when. When we change them in a way that needs your agreement, we'll ask again before you continue using your account.
• Keep your account to yourself. Don't share it, sell it, or create accounts to get around limits, suspensions or bans.
• Tell us at contact@communitycad.dev if you think someone else has accessed your account.
• Your username is public. Don't choose one that impersonates someone or is offensive.

3. Content#

"Content" means anything posted to the Service: models, files, images, descriptions, READMEs, datasheets, comments, ratings, print profiles, print posts (photos, videos and captions), and profile details.

3.1 You keep ownership#

You keep all rights you have in Content you post. We don't claim ownership of it.

3.2 The license you give us#

So we can run the Service, you give CommunityCAD a worldwide, non-exclusive, royalty-free license to host, store, copy, process, display, distribute and make available your Content through the Service. This includes:

• making derived versions needed to present it: preview renders, thumbnails, format conversions (for example STL exports of STEP files), extracted text from datasheets, search indexes, and resized or re-encoded images and video;
• showing it in the Service and when promoting the Service: for example in feeds, previews, newsletters and social media posts that link back to it, credited to you;
• letting other users download and use it under the license you chose (section 4).

This license ends when you delete the Content or your account, except:

• for copies others already downloaded under the Content's license;
• for Content you shared that's built into someone else's (for example, a reply to your comment);
• for a limited time in backups and caches, and where we must keep it by law.

You also give us permission to keep print profiles and print posts displayed on the model they're about, under your name (subject to your privacy settings), until you or we remove them.

3.3 What you promise about your Content#

When you post Content, you promise that:

• you own it or have every right needed to post it and to grant the licenses above and in section 4;
• it doesn't infringe anyone's intellectual property, privacy or other rights;
• it follows the Community Guidelines and the law;
• it contains no malware or anything designed to harm a computer, printer or machine.

3.4 We can remove Content#

We may review, refuse, hide or remove Content, and limit or close accounts, if we believe Content or behaviour breaks these Terms or the Guidelines, creates legal risk, or could harm someone. We don't have to review Content before it's posted and are not responsible for it, but we act on reports.

3.5 18+ content#

Some Content is for adults only. You must mark it 18+ when you post it: adult or sexual content, firearms and firearm parts, and graphic violence or gore. Moderators can mark Content 18+ themselves, and can remove Content that should have been marked and wasn't.

• 18+ Content is hidden from anyone under 18, and from anyone whose age we don't know, such as signed-out visitors. Adults see it blurred by default and can choose to show or hide it.
• 18+ Content never shows ads or a donation button.
• Firearm files: you may share files for firearms and firearm parts only where it's legal for you to do so, and they must be marked 18+. Laws about making, sharing and downloading such files differ by country and by US state; you're responsible for following the laws that apply to you, whether you upload or download. We remove such files when we receive a valid legal notice.
• Never allowed, marked or not: sexual content involving minors or anyone who appears to be a minor; intimate images of a real person shared without their consent; explosives, destructive devices and instructions for making them; and anything else illegal to distribute under US federal law. See the Community Guidelines.

4. Model licenses and using other people's models#

• When you upload a model, you choose its license, or attach one in a LICENSE file. That license governs what other users may do with it, in addition to these Terms.
• Licenses you grant to other users can't be withdrawn for copies already made, even if you later delete the model or change its license.
• If a model has no license, users may download it and make it only for their own personal, non-commercial use. They may not share, sell, publish or distribute it, or anything made from it, without the creator's permission.
• When you use someone else's model, follow its license. That includes crediting the creator and any share-alike or non-commercial terms.

5. Models imported from public sources#

Some models on CommunityCAD were imported from public GitHub repositories under the open licenses those repositories carry. Each is credited to its original author with a link to its source, and keeps that license. The original author can claim it by signing in with the matching GitHub account, or ask us to remove it at contact@communitycad.dev. We remove it on request. The license on an imported model is the one published by its source; we don't add rights it doesn't grant.

6. Printers, files and safety#

Please read this section carefully.

• Files on CommunityCAD are made by other users. We don't create, test, check or certify them. A model, G-code or other machine file can be inaccurate, unsuitable for your machine, or unsafe to make or use.
• Machine files (such as G-code) are made for a particular machine. Running a file made for a different machine can damage your equipment, cause a fire, or injure someone.
• Ratings, comments, print profiles, "Printed N times", printer-match and fit checks are information from other users or automated aids, not guarantees.
• You are solely responsible for deciding whether to make or use anything from the Service; for checking files, settings and materials before use; for supervising your printer or machine as its maker recommends; and for anything you make and how you use it, including load-bearing, safety-related and electrical parts.

Printers and the Klipper plugin#

If you link a printer using CommunityCAD for Klipper or another client:

• you authorise that printer to act on your account with the permissions you approve (such as downloading files and sharing print profiles and posts), until you disconnect it;
• you're responsible for the printer, everything it does, and everyone with access to it. Disconnect a printer you no longer control;
• files are only sent to or started on your printer by actions you or your printer take. Starting a print always requires your confirmation in the plugin;
• the plugin is provided under its own open-source license (Apache 2.0), with no warranty. That license covers the plugin's code only, not the Service or the CommunityCAD name;
• downloads to a printer count toward your download limits.

To the fullest extent the law allows, CommunityCAD is not liable for any damage to printers, machines or other property, or any injury, arising from files obtained through the Service or from printing, machining or using them. See also section 13.

7. Acceptable use#

Don't, and don't help anyone else to:

• break the law, or the Community Guidelines;
• infringe anyone's rights, or post someone's personal information without their consent;
• upload malware, or files designed to damage machines;
• access the Service by automated means other than the official API or plugin, scrape it, or collect data about other users;
• get around download limits, rate limits, review, suspensions or other restrictions, including with multiple accounts or shared printer tokens;
• interfere with the Service's security or operation, probe it for vulnerabilities without permission, or overload it;
• impersonate anyone, or misrepresent your connection to a company;
• manipulate ratings, likes, downloads, prints or donations, for example with fake accounts or coordinated rating.

8. The API#

The CommunityCAD API exists for the CommunityCAD for Klipper plugin and similar personal tools. You may use it for personal, non-commercial purposes, through tokens you create by linking a device, and within its rate limits. Commercial use of the API, including building a product or service on it, or bulk access to the catalog, requires a separate written agreement with CommunityCAD. Don't share or publish API tokens. We may change, limit or withdraw the API, or revoke tokens that are misused.

9. Memberships, payments and donations#

9.1 Memberships#

• Paid tiers (Supporter, Believer and Professional) are monthly subscriptions in US dollars, billed through our payment processor, Stripe, from the day you subscribe. They renew automatically every month until you cancel.
• You can cancel at any time in your account. Cancelling stops future charges; you keep the tier until the end of the period you've paid for.
• All subscription payments are final and non-refundable, including for any unused part of a billing period, except where the law requires otherwise. In rare cases (for example, a duplicate charge caused by a fault on our side) we may issue a refund at our sole discretion.
• Switching tier takes effect immediately and is prorated by Stripe.
• If a payment fails, the tier's benefits pause until a payment succeeds, and the subscription may end if payment keeps failing.
• What each tier includes (such as download limits and ad removal) is described on the Subscribe page and in the docs. We may change tiers, prices and limits; we'll give at least 30 days' notice of a price increase for an existing subscription, and you can cancel before it applies.
• Tiers can also be earned without paying, as described in the docs. Earned tiers depend on the conditions stated there, and may change or end if those conditions are no longer met or the programme changes.

9.2 Donations#

• Donations go to the creator through Stripe. Before you pay, you see the donation, the platform fee (the greater of $0.50 or 5% of the donation) and card processing. The total of those is what you pay. Creators receive the donation amount you chose; the platform fee is how CommunityCAD earns from donations.
• Monthly donations renew every month until you cancel, and cancelling stops them immediately.
• Donations are final and non-refundable, except where the law requires otherwise or, at our sole discretion, in rare cases such as fraud or a processing fault. A donation buys no product, service or right from the creator or from CommunityCAD.
• Receiving donations is covered by the Creator Terms.

9.3 Payment processing#

• All payments are processed by Stripe, under Stripe's terms. CommunityCAD never receives or stores your full card or bank details.
• CommunityCAD doesn't hold or move anyone's money. Donations go from the donor, through Stripe, directly to the creator's own Stripe account; the platform fee is collected by Stripe on our behalf. Subscription payments are collected by Stripe for CommunityCAD.
• Any refund, reversal or dispute is processed through Stripe and follows Stripe's rules and timelines. Card disputes are between you, your bank and Stripe.
• You authorise us, through Stripe, to charge your payment method for the amounts you approve, including recurring charges until you cancel. Prices don't include any taxes that may apply where you live.

10. Advertising#

The Service shows ads to signed-out visitors and Free-tier members. Ads are labelled. Some may be provided by third parties such as Google, as described in the Privacy Policy. We don't endorse advertisers or their products.

11. Sourcing and affiliate links#

Some model pages have a Sourcing tab listing where to buy the parts a model uses. Where a model's owner lets CommunityCAD add sources, we choose the products and some links are affiliate links: CommunityCAD may earn a commission from purchases made through them, at no extra cost to you. As an Amazon Associate we earn from qualifying purchases. Affiliate links are marked, and the tab says so above its list.

Links an owner adds themselves are shown as they entered them. Sources are information, not advice or endorsement: products, prices and availability are set by the retailer, may change, and may be wrong, and purchases are between you and the retailer under its terms.

12. Beta and changing features#

Some features, including the CommunityCAD for Klipper plugin, are offered as beta or early access. They may be incomplete, change or be withdrawn, and may have bugs. We may add, change or remove features of the Service at any time.

13. Disclaimers#

The Service, all Content, and all files are provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, safety, non-infringement, and that the Service will be uninterrupted or error-free. We don't warrant any Content posted by users, and we're not responsible for it.

Some places don't allow these exclusions, so some may not apply to you.

14. Limitation of liability#

To the fullest extent the law allows:

• CommunityCAD and Iron Pixel Labs LLC, and their owners, employees and contractors, are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data, goodwill, or damage to equipment or property, arising from or related to the Service, any Content or files, or these Terms, even if we were told such damages were possible;
• our total liability for any claim related to the Service is limited to the greater of (a) the amount you paid CommunityCAD in the 12 months before the claim (not counting donations passed to creators), or (b) US $50.

Nothing in these Terms limits liability that can't be limited by law, such as for fraud, or for death or personal injury caused by our negligence where the law doesn't allow it to be excluded.

15. Indemnity#

You agree to defend and compensate CommunityCAD and Iron Pixel Labs LLC against claims, losses and costs (including reasonable legal fees) arising from your Content, your use of the Service or of anything made from Content you obtained, your printers and devices, or your breaking these Terms or the law.

16. Ending your use#

• You can stop using the Service at any time, and ask us to delete your account at contact@communitycad.dev.
• We may suspend or close your account, or restrict features, if you break these Terms or the Guidelines, if we have to by law, or to protect the Service or other people. Where reasonable, we'll tell you why.
• If your account is closed, active subscriptions are cancelled. Sections that by their nature should continue (including 3.2 as described there, 4, 6, 12, 13, 14 and 17) continue to apply.

17. Changes to these Terms#

We may update these Terms. The date at the top shows when they last changed. For significant changes, we'll give notice on the site or by email before they take effect. If you keep using the Service after changes take effect, you accept them; if you don't agree, stop using it and close your account.

18. Governing law and disputes#

• These Terms are governed by the laws of the State of Florida, USA, and applicable US federal law, without regard to conflict-of-law rules.
• If you have a problem, please email us first. Most issues can be sorted out quickly.
• Any dispute that can't be resolved informally will be brought only in the state or federal courts located in Florida, and you and we consent to their jurisdiction, except that either of us may bring a claim in small-claims court where it qualifies.
• If you live in a country whose consumer laws give you the right to bring claims in your local courts, or to the protection of local law, these Terms don't take that right away.

19. Other terms#

• These Terms, with the documents they refer to, are the whole agreement between you and us about the Service.
• If any part is found unenforceable, the rest stays in effect.
• If we don't enforce a part right away, we don't give up the right to enforce it later.
• You can't transfer these Terms to someone else. We may transfer them as part of a reorganisation, merger or sale of the Service.
